These Terms and Conditions (hereafter: Conditions) regulate access to or use of products, applications, web site, or content (hereinafter: Service) belonging Cargo Technologies Ltd. or its subsidiaries and affiliates (hereinafter referred to as CAR:GO).
Please carefully read the terms and conditions before accessing or using the Service.
Your access to and use of the Services, you represent that you have read, understood and agree to these conditions, which establishes a contractual relationship between you and the CAR:GO and shall supersede any previous contracts, agreements or arrangements of any kind between the two sides.
CAR:GO reserves the right to unilaterally change the Terms and Conditions, terminate provision of the Services or any part thereof, at any time and for any reason, in accordance with the process described in these Terms. Your future access to and use of the Service constitutes your consent to amendments to the conditions.
Services represent a modern technology platform – a set of software, which allows users CAR:GO mobile applications or CAR:GO of the website to get in touch, or use the reserve and off-line transport services provided by third parties – commercial entities registered for the performance of services off-line transport of people and things.
CAR:GO IS NOT economical subject registered for performing of off-line transportation of persons and things, nor do they provide such a service.
Unless otherwise agreed, it is understood that the services CAR:GO’s available exclusively for personal, non-commercial purposes.
In accordance with these Terms, CAR:GO offers you a limited, non-exclusive, revocable, non-transferable right to use the service through the access and use of mobile applications on your device, or access to, and use of the website, and also through the use of any content, information and content that may be made available, and in any event exclusively for personal and non-commercial use, unless otherwise agreed.
During the application of these Terms and using the Service, You must not: (a) removing a logo, trademark or any of the copyright or related rights from any part of the Services; (B) sell, copy, distribute, offer, rent or in any way commercially exploit Services, unless there is a particular CAR:GO license; (C) amend, modify, or disassemble any part of the Services; (D) use any portion of the Service in order to collect statistical data, indexing, research, or disrupt the functionality of any aspect of the Services; (S) or try to make unauthorized access to the Service which may jeopardize the provision of service, any part thereof, associated with system or network.
SERVICES OF THIRD PARTIES
Please note that by “third parties” for the purposes of these Terms and considered Apple Inc., Google Inc., Microsoft Corporation or Limited BlackBerry, if you use the Services through developed mobile applications for Apple iOS, Android, Windows or Blackberry mobile operating system. The said third parties are not party to these Terms and are not responsible for providing services or support in any way.
Services, all copyrights, trade secrets, data and other rights are and remain the exclusive property CAR:GO Technologies Ltd. Acceptance conditions, the limited right to use the service, as described in the previous paragraphs, but not the right to use the business name and the name CAR:GO’s, logos, product names or CAR:GO’s trademarks.
2. USER ACCOUNTS
To be able to use all aspects to the Service, you must register and create your own user account. A precondition of registration is at least 18, or that you have full legal capacity according to the regulations of the Republic of Serbia. When registering CAR:GO reserves the right to this purpose collects personal information such as name, address, mobile number, email address, age, and information on a valid method of payment service. Your duty is to bear in mind that during the whole of using your registered user account information to be accurate or current. If certain aspects of the service to be available because of the registered incorrect data, CAR:GO cannot be held responsible. Also, you are responsible under the legal provisions for all activities that occur in your user account and you agree to maintain the confidentiality of their user credentials, or that anyone will not disclose any of your user name and password to access the system. You may not authorize third parties to use your account, or it can be in any other way transferred to a third party. In some cases, you will be asked to provide proof of identity to be given the service and failure with the request may result in denial of services.
NETWORK AND APPROACH
To have been given the service it is necessary to have a device which has access to the Internet. When using the Service you may be charged for the data service at the price charged by your mobile operator.
Also, when using the Services software monitors the GPS location of your mobile device and collects information about your current location. By using the Services, you agree that this information may be collected and used only for purposes of functioning applications.
By accepting these Terms you agree to use the Service will have to pay a price to third parties – business entities that are registered for the provision of services off-line transport of people and things. After the service is completed, the CAR:GO will forward your payment accrued costs to third parties that have carried out the transport. Payment using the Service in this way will be considered the same as that payment is made directly to third parties. The amount that will be charged includes all taxes and taxes determined by the applicable legislation.
When creating accounts users are obliged to provide information on a valid method of payment and information about your credit card or PayPal account.
If you are using PayPal account as a payment service, you select predefined amount from the offered list, which informs us to move selected amount from your PayPal account on the balance of your user account. Before starting the use of the Service, it is necessary to link one of the available payment methods to your account, or pay a minimum loan amount of RSD 500.00. Services will be charged from your user account balance by charging the appropriate amount based on CAR:GO pricelist, depending on the extent of use of the Service and the calculation that you will get on your registered email address each time you use the Service. At any time, to check the current status of funds in your user account.
Stipulated by the laws and regulations of the Republic of Serbia considering limitation of the usage of PayPal, this method of payment inside the app can only be used by a non-resident person of the Republic of Serbia.
If you are using credit card as a payment service, you register your selected credit card inside the app once, by providing credit card information and the means from it are used only when your ride has just taken place and is finished, it is only then when the funds from your credit/debit card are collected.
When entering payment card information, confidential information is transmitted through a public network in a protected (encrypted) form. The security of the data during the purchase is guaranteed by the payment card acceptor, Societe Generale Belgrade, so the complete collection process is carried out on the bank’s pages. Non of this information is available on our system.
When you add a payment card, 1.00 RSD will be reserved to verify the card, after a certain time (up to 7 days), this value will be refunded.
All payments will be effected in Serbian currency – dinar (RSD). The amount your credit card account will be charged for is obtained through the conversion of the price in shown currency into Serbian dinar according to the current exchange rate of the Serbian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations/your issuing bank. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site and your credit card bank statement. T hank you for your understanding.
Telekom Srbija AD + CAR:GO
We inform you that mts represents „Cargo Technologies“ d.o.o. in contract conclusion process for using Car:Go service and charging Car:Go vouchers, therefore your obligations towards „Cargo Technologies“ d.o.o. will be settled only after settling related obligations towards mts.
CAR:GO will not charge service to advance a prominent price list. CAR:GO reserves the right at any time change the established price list, but with the obligation to immediately highlight the new price list on its website, as well as to inform users.
Prices stated in the price list include only the amount of compensation for the service in itself does not contain a “kickback” or “tip” as an additional reward the driver for quality of service provided. If you want you can further reward the driver, but you are not required to, and it depends only on your will.
In the event that after a drive request, driver shows up but you cancel a ride, you will be charged a cancellation fee, which will also be pre-stated.
CLEANING OR REPAIR FEE
If in the course of using the Service by your fault or damage occurs to the carrier vehicle (physical damage or soiling) that go beyond “exemplary damages”, You will be responsible for the costs of removing such damage.
If this situation occurs, the carrier – the third person will be addressed CAR:GO with a request and a detailed report of the damage. If CAR:GO checking the received request that the damage is justified, CAR:GO reserves the right to the user account or with the reported method of payment, invoices the appropriate amount corresponding to the damage incurred.
POLICY OF RECLAMATION
In the event that a user is charged an account for services that have not been performed in accordance with this agreement, the user is authorized to send a complaint via telephone in working time to the CAR:GO contact phone or electronically via the CAR:GO website.
All complaints will be settled within the legal deadlines.
REIMBURSEMENT OF PAID FUNDS
In the event of the return of funds to the user who previously paid via payment cards, in whole or in part, and regardless of the reason for the return, CAR:GO is obliged to make a refund solely through VISA, EC / MC and Maestro payment methods, which means that at the request of the seller, the bank will make a refund to the account of the payment card user.
4. WARNINGS, LIMITATION OF LIABILITY, INDEMNIFICATION
CAR:GO is not a business entity registered to perform off-line transport of persons and things, or provide such a service. CAR:GO provides mediation services between end users and third parties – carriers, who provide transport.
Accordingly, CAR:GO does not guarantee in connection with the services performed by the carrier – the quality of transport, time accuracy, availability of service without interruption at certain parts of the territory, security, transport services or duration. By accepting these Terms you agree that you bear the entire risk arising out of use of the Services.
CAR:GO is not liable for indirect, incidental, punitive, or consequential damages (eg. Missed profits, data loss, injury, material damage) that may arise in the course of or in connection with use of the Services. CAR:GO will also not be responsible for any damage: a) due to the current inability to use the service if it is a result of the inability of your mistakes; b) in the course of direct transaction between you and a third party – service providers; c) due to the delay or failure in the delivery of services, if the failure was caused by force majeure or unforeseeable circumstances.
The restrictions listed in this section of the Terms are not intended exclusion or modification of your rights as a consumer which are guaranteed by the legal system of the Republic of Serbia.
By accepting these Terms you agree to CAR:GO-or its employees to compensate all damages, including attorneys’ fees and court proceedings, which result from: a) your use of the service by the established rules; b) a violation of any provision of these Terms; c) misuse of confidential information; d) violation of the rights of any third party providing services described in these Terms.
5. CAMERAS FOR VIDEO AND AUDIO RECORDING IN VEHICLES
Your security in mind, improving service quality, as well as preventing misusage, CarGo vehicles can be equipped with cameras recording video and audio. Camera lens is facing forward through the windshield in a driving direction. Cameras can't record passenger area, therefore, your face would not be subjected to the recording. However, since the camera is recording through the windshield, it is possible that you can be recorded in case that you are occupying the pubic area in camera scope while waiting for service or if You are entering the vehicle from the front side. In that scenario, recording can contain Your footage as part of public area. Since cameras are recording sound as well, sounds within the cabin can be recorded. CarGo will not provide any footage to third parties but can be instructed by civil services (like court or public attorney) to grant access to footage. In that case, You will be notified of the existence of such request (except in cases where request is strict in forbidding) and CarGo will oblige that sort of request in minimum possible way. Accepting our service, you are agreeing to allow us to use video and audio recordings in enlisted ways. Friends, family members, and guests that are using your account in accordance with Organization Stature you should notify.
6. ACCEPTABLE USE AND CONDUCT
By accepting these Terms you agree that you may not use the Services in a manner that is harassing, defamatory, unlawful, threatening, harmful, abusive, violates a person’s privacy or is in any other way unwanted, contrary to the law or bylaws. In addition, you agree that you will not use the Service to: a) upload, download or distribute any software whose purpose is to damage or alter the software system or data; b) sending of unwanted or intrusive advertisements, promotional materials, spam, obscene or offensive content, chain e-mails or any other type of spam; c) the collection and processing of information about other users of the Services without their consent; d) disruption or distortion of the labor servers or networks connected to the Service; e) unauthorized access to the Service through other computer systems or networks; f) harassment or interference with the use of other users of the Services.
CAR:GO reserves the right to investigate specific situations and take appropriate action against you if it is determined that you are in the course of using the Service in any way violate the provisions of these Terms. Under appropriate measures implies the possibility of a temporary suspension or permanent deactivation of user accounts and the launching of legal proceedings. Also, CAR:GO withholds the right to cooperate with state authorities and their legally prescribed request them to submit relevant information regarding the user’s account, including the IP address, information about Internet traffic from your device, the archive users alike.
CAR:GO will announce all the changes of conditions on its website and within the CAR:GO mobile applications at least 30 days prior to the entry into force of the changes. By the time of the entry into force of the amendment will apply the previous provisions of the Terms. For new users will immediately apply the new provisions of the Terms.
8. DISPUTE RESOLUTION
By accepting these Terms you agree that any dispute between you and the CAR:GO, which occur during use or in connection with the Services, will be resolved amicably, the dialogue between the two sides. If you turn to a negotiated settlement cannot be reached, either party to the dispute has the right to take appropriate legal or other proceedings before the competent state organs of the Republic of Serbia, in order to protect the rights that the party believes that the threatened or injured.
9. TERM AND TERMINATION
These terms and conditions shall enter into force on the date of your acceptance thereof and have effect for all time use of the Services.

CAR:GO will try to respond to all requests within a reasonable time, in accordance with the law.
11. TOTAL AGREEMENT
